Sale Conditions

Changes may be made to these Terms and Conditions from time to time:
please consult the website regularly for updates. The latest version of these conditions of sale will always be available on the platforms.
A new version of these Terms of Sale shall take effect immediately on the date of dispatch and shall  regulate product orders or services placed on or after that date. Changes to Terms and Conditions of sales after the order has been placed shall not affect it or the relationships with us, except as may be required by applicable law.
  • Purchases

Purchase may be made by persons (or non-legal entities) who:

(a) have reached the required age of majority to enter into contracts (eighteen in most Countries.

(b) have the legal capacity to conclude contracts,

(c) use a shipping address in the Country or Countries we ship to (as specified by the sales channels) and can order products through sales channels. Minors, unless otherwise stipulated, do not have the right to lawfully enter into a contract and are required to use their parent or legal guardian to place an order on their behalf and will be obliged to accept these Terms and Conditions of Sale. When placing an order through the website, customer declares and ensures in good faith to buy for its own personal use or for another person and will not provide deliver, sell or distribute our products or purchase our products or service for commercial purpose.

  • Product availability and quantity

All orders placed through the online site are subject to availability and our acceptance. Products displayed on the platforms that cannot be added to the shopping cart are not available for sale on the platforms. Customer service can provide more information about these products. Quantity limits may be applied to orders for certain products. We reserve the right to refuse orders exceeding a certain number of authorised products at any time without prior notice.

  • Customised services

Customisation of services can be applied on a selection of products. If you wish to personalise a product, please provide details on the online site as requested. We reserve the right to accept or refuse any order for personalised products, or with a message card that contains language that is objectionable, unlawful or contrary to our policies. The customer is responsible for ensuring the accuracy of the wording provided for customised products. In addition, orders for personalised products cannot be cancelled and such products that have been personalised in any way or otherwise made differently from specifications cannot be returned to us for exchange or refund as described in these Conditions of Sale.

  • Sale prices

The unit prices are expressed in Euro and are indicated for each product in the reference pages of the website. Selling prices for each product include VAT and any other taxes, unless otherwise specified.

The total price of all purchased products and shipping fees is automatically calculated by the payment system and given in the reference pages of the website. The Supplier reserves the right to make promotions with discounts on purchased goods or on shipping, by  coupon.

  • Order process

The Platform order Process includes the following:

Add to cart: once the item has been chosen, it can be placed in the cart. You may then decide to continue shopping for other products and add them to your cart (subject to availability and quantity limits). Placing an item in your cart does not guarantee availability for purchase, which is not confirmed until you receive a written Confirmation of Order & Shipment.

Order sent: once you have selected your items proceed with the “order”as sent.

You can also remove any products from your cart as part of the payment process.

Delivery, Review and Payment: as part of the checkout process, you add and review your order details and personal information ( including e-mail,shipping,address, billing address and payment information). You should carefully check and confirm all details on the order summary page before placing your order.

Placing of Order: you then check the relevant box and place your order. In the case of an order being placed through the Client Relations Center, our staff will walk you through the steps above and verbally ask you to confirm the datails of you order.

Notwithstanding anything to the contrary provided for herein, we reserve the right to refuse, cancel and terminate orders at any moment in time. For example: we are entitled to refuse, to stop or cancel your order in the event of an outstanding dispute about payment for a previous order or, in our sole discretion, in case of suspicious fraudulent activities or any violation of  these Condition of Sale.

  • Prices, taxes and shipping

All prices shown on the product pages of the Platforms or quoted by the Client Relations Center include the applicable VAT, but exclude shipping costs and other taxes unless otherwise stated.

Sales, use or other taxes will vary based on the location to which products are being shipped.

Shipping costs are not stated  on the product pages but will be added to the product price after you have chosen your delivery options.

These costs will be summarised before you are asked to confirm and place your order and will also be reflected in our written  Confirmation of Order & Shipment/Acknowledgement of Order once you have chosen your delivery options. We reserve the right to amend prices and shipping costs

without prior notice at any time. We take reasonable care that prices of products are correct at the time when the relevant information was entered into the system or communicated to you via the Client Relations Center. However, it is always possible that, despite our reasonable efforts, some of the products offered through our Sales Channel or delivery costs may be incorrectly priced.

We will contact you as soon as possible in the case of one of the required products shows an incorrect price or of an error in shipping costs. If we are unable to contact you using the contact details you have provided, we will tread the order as cancelled by sending a written notification.

If we mistakenly accept and process your order where a pricing error occurs, we may cancel supply of the product and refund you any sums you have paid. Please note that changes to applicable law between the date your order is placed and the date you are sent a written Confirmation of Order & Shipment may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order.

  • Payment

We accept the methods of payment offered on the website via the online site. Depending upon the means of payment, we may require additional information, including specific forms of identification. When ordering on the Platforms, you will need to enter your payment details on the appropriate form. In case of telephone order you need to notify to the customer service your  complete payment details.

All  credit card holders are subject to validation and security checks as well as authorisation by the card issuer. If the payment card issuer negates the authorisation to pay the dues, the customer will take charge of contacting the issuer to resolve the problem. Other payment methods may also be subject to validation checks and authorisation by the payment system providers as well.

If we deem it necessary, you expressly allow us  to perform security checks, to transmit or obtain information ( including any updated information) about you or third parties, for any reason including but not limited to: payment card details,identity authentication, validation from the User’s payment card, obtain  an initial credit authorisation from your payment card issuer, authorise purchases.

The full amount of your purchase will typically be blocked on your payment card until your order is shipped, at which point in time you will be sent a Confirmation of Order & Shipment and your payment card will be charged the applicable purchase price.

When using a credit card/debit card/PayPal as a payment method, the full amount of your purchase may be debited on your payment card immediately following the placement of your order.

Pre-payment shall not impact any of your legal rights under these Conditions of Sale (includingfor example any right of refund). Once your order is shipped, you will be sent a confirmation of order and shipment.

 If we cannot meet our shipping and/or delivery obligations set out below, we will notify you via e-mail and we will refund the pre-payment without undue delay.

 When paying by credit/debit card, the full amount of your purchase will typically be blockedon your payment card until your order is shipped, at which point in time you will be sent a Confirmation of Order & Shipment and your payment card will be charged the applicable purchase price.

We may accept bank transfer at our sole discretion.

We do not charge a fee for bank wire transfer for orders made through our on line site

or Client Relations Centre, however, some financial institutions may charge a fee for using a bank wire transfer. We request confirmation of all  phone bank transfer orders received by a process of approval of the order.

We may acknowledge a bank wire transfer order, but the order will not be processed until the payment has been received and confirmed by us by e-mail. If your wire transfer payment is not credited into our bank account within seven (7) days after you have placed your order, your order will be cancelled.

  • Availability of products   Consent for replacement

In the event that a product is not available, the Supplier will  promptly inform the Customer by seven (7) working days from receipt of order. The Customer will be refunded any amounts collected for the purchase of the unavailable products, unless the Customer expressly consents to replace the selected product by an other equivalent or higher value and quality product.  In any case, the Supplier will deliver the available and/or replaced goods leaving original shipping costs unaltered, in favor of Customer.

  • Shipping policy

We only accept orders for delivery to the Country or Countries that are identified during the Order Process.  Please note that we do not ship to certain addresses, such as military, certain restricted areas, pick-up points or PO boxes. If you order several products, we will ship the order only once all products are available (there will be no partial shipments unless otherwise communicated to you).

  • Manufacturer’s guarantee and consumer rights

We are extremely cautious in ensuringthat each product strictly complies with our quality criteria and that it has passed all our controls, both technical and aesthetic. All products selectedare covered by the producer’s guarantee.If you want to repair a product covered by warranty, please contact Customer Service for more information.

  • Governing Law & Jurisdiction

The sales contract with CA DA Srls is deemed stipulated in Italy and is governed by the Italian Law.

All disputes over the application, performance, interpretation or breach of the purchase contracts concluded on the website are governed by Italian Law and  will be referred to the competent judicial authority of the place of residence or elective domicile of the  customer, if located in the territory of the State. In all other cases the only competent court will be that of Piacenza (PC).
